I was wondering, I wanted to use a town in my game that isn't fiction. Can I do that, is it a bad idea, or do I need permission?

It really depednds on how you portray the town. If you make fun of it, it's most likely a bad idea. People also tend to get critical if their town isnt protrayed the same way as they see it. Generally, unless you are super familiar with the place (like, you practically/literally live there) you'll need to be careful with using real places in your games. I think you might need permission only if you're going to sell the game.

There's no problem in that. Lots of game companies use classical music as themes for their characters.
